MSW UTEP Student Statement on TSBSWE Ruling - Code of Conduct

"We, the students in the Masters of Social Work Program at the University of Texas at El Paso UTEP, stand for Social Justice and Equality for all. On October 12, 2020 the Texas State Board of Examiners (TSBSWE) and Behavioral Health Executive Council (BHEC), severely restricted the Social Work Field after a last-minute rule from the Governor’s Office was proposed and accepted in the rules. It alters the Social Work Code of Conduct (RULE §781.201.)  This rule stated: A social worker shall not refuse to perform any act or service for which the person is licensed solely on the basis of a client's age; gender; race; color; religion; national origin; disability; sexual orientation; gender identity and expression; or political affiliation. The new rule form the Governor’s Office removed the protections for Gender Identity and Sexual Orientation. Social Justice is a core social work value and it demands that all social workers, whether practitioner, academic, or researcher, uphold our Code of Ethics by taking deliberate actions to ensure that justice and equity exist in all communities. Social workers understand the history of oppression that has led the LGBTQAI Community to feel unsafe and unserved and the equality that has been gained in the recent additions to Title VII of the Civil Rights Act of 1964 prohibits workplace discrimination based on religion, national origin, race, color, gender, or sexual orientation.  With the changes if accepted to the Social Work Code of Conduct, this protection of equality will be lost and allow for discrimination to take place. As social workers, it is our duty and ethical responsibility to address discrimination and all forms of social injustice by supporting and advocating for the change in the Social Work Code of Conduct to be overthrown and have it reverted back to protect the service for all, immediately."
